Neighbor Dispute in Utah

A city councilman in Utah , Mark Easton, had a beautiful view of the east mountains,until a new neighbor purchased the lot below his house and built a new home.

The new home was 18 inches higher than the ordinances would allow, so Mark Easton, mad about his lost view, went to the city to make sure they enforced the lower roof line ordinance. The new neighbor had to drop the roof line, at great expense.

Recently, Mark Easton called the city, and informed them that his new neighbor had installed some vents on the side of his home. Mark didn't like the look of these vents and asked the city to investigate. When they went to Mark's home to see the vent view, this is what they found...

I feel bad for Mark Easton. It sucks to have someone come along and build something that ruins your view. And if you don't bother to read the laws before you build something, you deserve what you get.

18 inches is a foot and a half. A foot and a half makes a big difference when you're blocking someone else's view.

Is the city going to do anything about the vents? I can imagine the neighbor being prosecuted for a public nuisance, or ruining Mark's "quiet enjoyment of his home" (which is a right protected by law in many places).

i think the vents got taken down after easton gave some half-apology. there was a drive to declare them obscene.

The thing is, his building plans had to be approved before he could start construction and it had to be inspected periodicaly during construction. As far as the owner of the house in question was concerned, he was well within his rights due to the approval he had received.

That does make a difference -- at least where logic and good sense are concerned. :roll:

Wonder if the city pulled out a legal theory I've seen used a bunch of times? It's basically, "We're the government and we hold all the cards, so if somebody who works for us screws up, we can't be held accountable. So you have to do what we say anyway."

Under that theory, the city could very well say to Frustrated Neighbor, "Hey, we know we approved all of your permits and everything, but we screwed up, so you have to change everything and foot the bill besides."

If that was the case, my sympathy would switch to the neighbor's side.
