copyright laws

Ok so I have a few ?in's about it but ill start off with my main one


I read(tryed to) the copy right laws now as long as you have a tangable prove you made it first it doesnt matter if someone else applys for secure copyright its still yours?

like

1/1/06 xentis-writes a book and doesnt get a secure copyright
1/10/06 CNG-writes a book with the same name and image as xentis but applys for secure copyright


would that mean CNG now has rights to the image and name?

what we learned in my journalistic legal classes is that as long as you have a hard copy, and you can legisticslly prove you wrote it ( ex: keep the original, share the copy) you do not need a certificae claiming copyright.

and really that is all it is. another piece of paper. most writers/artists don't get one.
